Acting for Buyer

 

Our firm will advise the client on the process of a conveyancing transaction

We will find out as much about the property as possible before our client enters into a binding contract to purchase it. This will be made in the form of pre-contract searches and enquiries.

An investigation of the title to the property being purchased will be made to ensure that the seller is able to transfer the property which they have contracted to sell and that there are no defects in the title which adversely affect the interests of the buyer or his lender. We will also check any surveys that have been commissioned before our client enters into a contract.

In the event that the documentary evidence supplied by the seller is not satisfactory or clear we will raise the relevant queries by raising requisitions.

The reason for a thorough investigation before purchase is because of the caveat emptor (buyer beware) rule which places the onus on the buyer of discovering any physical faults in the property before entering into a contract.

We will work with our client to make any amendments to the contract where it is necessary and relevant to the particular transaction.

Before entering into an exchange of contracts we will ensure that all outstanding matters and queries have been dealt with and that our clientsí financial arrangements are in order before committing the client to the contract and report to the client on our findings.

Provided our client is satisfied with the investigation of title we will then agree a completion date with the client and exchange in accordance with their instructions.

Before completion of the purchase we shall agree a completion date with our client, prepare the purchase deed, finalise the mortgage and apply for the final searches.

On completion we shall agree a time, place and method of completion with the sellerís solicitor; also we shall arrange for the transfer of funds.

Post-completion, our firm will complete the mortgage deed, attend to payment of stamp duty land tax and register the title with the Land Registry.
